Acceptance of Terms

By accessing or using Capture.Study ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Capture.Study provides a cloud-based platform for clinical research data collection, including:

  • Electronic Patient Reported Outcomes (ePRO) and Clinical Outcomes Assessment (eCOA)
  • Electronic Data Capture (EDC)
  • Electronic Consent (eConsent)
  • Multi-site study management
  • Data analytics and export capabilities

User Accounts and Responsibilities

Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access or security breach

Account Responsibility

You are responsible for all activities that occur under your account. You must comply with all applicable laws and regulations when using the Service, including but not limited to HIPAA, GDPR, and GCP guidelines where applicable.

Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Upload or transmit viruses, malware, or other malicious code
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to violate the privacy or rights of others
  • Share your account credentials with unauthorized individuals

Intellectual Property

Our Rights

The Service and its original content, features, and functionality are owned by Capture.Study and are protected by international copyright, trademark, and other intellectual property laws.

Your Rights

You retain all rights to the data you input into the Service. By using the Service, you grant us a limited license to host, store, and process your data solely to provide the Service to you.

Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Payment Terms

If you purchase a paid subscription:

  • Fees are charged per participant per month based on your selected plan
  • Payment is due in advance of each billing period
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days' notice
  • You are responsible for all taxes associated with your purchase

Disclaimers and Limitation of Liability

Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CAPTURE.STUDY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

Indemnification

You agree to indemnify, defend, and hold harmless Capture.Study and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service:

  • Immediately if you breach these Terms
  • With notice if you fail to pay applicable fees
  • At our discretion with reasonable notice

You may terminate your account at any time by contacting us. Upon termination, you may export your data within 30 days, after which it may be permanently deleted.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Capture.Study is incorporated, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
